Rental of luxury apartments in Lille

General Terms and Conditions

Article 1 - Applicable Regulations
This contract is subject to the legal status applicable to tourist residences. The resident occupant may not, under any circumstances, elect 30 Rue Paul Duez as their primary or secondary residence. The resident occupant may not make use of the legal provisions applicable to residential leases, notably with regard to tenancies. Any registration of address at the residence, whether in a private or professional capacity, is prohibited.
Article 2 - Booking
The booking of an apartment at 30 Rue Paul Duez shall only be deemed valid when we accept it. Confirmation of the client's booking by "Au 30" remains at the discretion of "Au 30".
Furthermore, in order to be confirmed, the reservation should be guaranteed by payment of a deposit or the full rental amount.
When booking, the renter shall notify of their arrival and departure times so that the person in charge of "Au 30" may be present.
Article 3 - Payment Conditions
The bill issued by "Au 30" is to be paid immediately upon presentation, and at the latest on the day of the client's arrival.
Article 4 - Check-In - Bank Deposit
On the day of the occupant's arrival, a valid credit card issued by a reputable banking institution will be requested so that a banking pre-authorisation in the amount of €500 or €1,000 can be made, depending on the apartment selected. This deposit will only be redeemed by "Au 30" in the event of proven damages caused to the rented apartment. It will be cancelled within a maximum period of 3 weeks following the resident's departure, upon verification that no damages have been found in the rented apartment.
In the event that it is agreed that payment for the rental by the occupant will be carried out by a third party, pre-authorisation will be carried out via the bank card of the resident occupant on their arrival.
If the security deposit is insufficient, the resident occupant agrees to pay the difference on evidence provided by the owner or their representative.
Upon their arrival, the occupant must be able to present a valid identity document and "Au 30" will retain this information.
Unless otherwise agreed by the hotelier, on their arrival the client may not demand to occupy the room before 5.00 pm. Night rental shall cease at 11.00 pm. Loss of a swipe card or key will incur a charge of €50.
Article 5 - Price
The prices are listed in Euros and include all taxes, including VAT at the rate currently in force. Any subsequent changes to the VAT rate in force or any creation of new taxes for the services provided, which occurred between the time when the rates were established and when billing took place, will lead to a change in the fully inclusive price.
The price stated does not include the tourist tax (2016 amount: € 2.48 per person per night). Some optional services are not included (see the attached table of public rates).
Our prices always include the provision of accommodation, bedding, towels, water, electricity, heating and service charges.
Article 6 - Changes to the Booking or Duration of Stay
Subject to availability and at the discretion of "Au 30", the duration of stay may be extended, without any obligations to maintain the same apartment and price.
If the new date requested means that the stay will be curtailed, this will not facilitate a refund or a change in the payable balance provided on arrival.
Any started, interrupted or curtailed stay may not give rise to any refund. Any changes to a reservation made through a third party (most notably on the Internet) must be changed exclusively by the latter.
Article 7 - Cancellations / No-Show
Cancellation
In the event of cancellation, the deposit will not be returned. "Au 30" may request the payment of the total amount of the rental in case of late cancellation (7 days or fewer before the arrival date).
"Au 30" should be informed of the cancellation of the stay in writing (by letter or email). The effective date of cancellation will be the date of receipt of the email or letter. Any cancellation of a booking made through a third party (most notably on the Internet) must be carried out exclusively by the latter.
The person who made the booking who does not appear on the expected arrival date will be charged for the full booking amount.
Article 8 - Obligations of the Parties
"Au 30" undertakes to provide the resident occupant with accommodation that is in good functional conditions.
The resident occupant undertakes to use the rented premises and its facilities in a reasonable and sensible manner.
An inventory has been placed in each apartment. Upon their arrival, the occupant should ensure that it is accurate and notify reception of any abnormalities, missing or damaged items, where necessary, within 4 hours of their arrival. Upon the occupant's departure, the apartment inventory will be checked by "Au 30" and any missing items or damages caused to the apartment shall be charged to the occupant.
"Au 30" reserves the right to enter the rented premises for maintenance or safety purposes.
For security reasons, no apartment can be occupied by a number greater that the number of people for whom the booking was originally made. Children are considered to be regular occupants. Any overspending will be refused.
Each resident agrees to respect the terms of use of the various facilities described in the preceding pages (Jacuzzis, saunas, steam room and gym), so as not to damage them or put their own lives in danger.
Article 9 - Respect for other guests
Whether in the residence complex or in one of the private apartments, excess noise, even during daylight hours, is not permitted. Any client causing disorder or disturbances of any kind may be ejected forthwith. In the interests of peace and quite of the facility, all noise must stop between the hours of 10.00 pm and 7.00 am.
Article 10 - Prohibitions
For reasons of safety and out of respect for all guests, it is prohibited to smoke in the apartments and common areas. In compliance with Decree No. 2006-1386 of 15 November 2006, establishing the conditions for implementing the ban on smoking in places designated for collective use, smoking at "Au 30" will render you liable for an additional charge of €70 or for legal prosecution. Any unnecessary sounding of the fire alarm due to non-compliance with this provision will be charged €150 as a service cost for the fire safety system.
For reasons of hygiene, pets are not allowed.
Article 11 - Damages
The client must make use of the rented property in a responsible manner. In the event of problems, the client will assume civil liability. In case of damages, "Au 30" reserves the right to charge the client the cost for repairs or replacement. The same applies for any infringements found after the client's departure. The compensation amount will be charged to the client's bank card.
Article 12 - Responsibilities
"Au 30" cannot be held liable in case of theft or damages to personal belongings in the apartments, including in the common areas. As this accommodation contract is subject to the legal status applicable to tourist residences, the provisions of Articles 1952 and following of the French Civil Code concerning hoteliers do not apply.
"Au 30" will not be held responsible for any difficulties that may disrupt, interrupt or prevent your stay in case of force majeure or unforeseeable circumstances, such as drought, floods, general outages of electricity, gas and water and strikes and labour disputes, etc.
Children are the sole responsibility of the client.
Article 13 - Termination - Penalties - Non-renewal
This contract will be immediately and automatically terminated without legal formalities should the occupant fail to comply with any of these obligations or for inappropriate behaviour that is likely to disturb the stay of the other occupants. The occupant must leave the premises immediately and may be evicted if necessary.
Non-payment for the stay shall lead to relinquishment of the use of the leasing contract and the keys being returned to "Au 30", with express renunciation of tenure.
Article 14 - Respect for privacy
In accordance with the Data Protection Law, the occupant is entitled to access, amend and oppose their personal data. In order to do so, they should make a request in writing, at no charges other than those for sending: to "Au 30", 30 Rue Paul Duez 59800 Lille.
Article 15 - Departure
Upon their departure, the client must return the key to their room and their night access swipe card to the designated person for "Au 30".
Article 16 - Opening Hours
"Au 30" is open on weekdays from 7.00 am to 11.00 am and from 5.00 pm to 7.00 pm, and on Saturdays, Sundays and holidays from 8.00 am to 11.00 am and from 5.00 pm to 7.00 pm.
Article 17 - Acceptance of Internal Rules
The internal rules of "Au 30" apply to all bookings. Every stay involves the acceptance of the specific conditions and internal rules of "Au 30". Non-compliance with the above provisions shall result in the immediate termination of the contract.
